Apple wait to Dec 6th for Samsung product ban hearing

Apple have requested that eight Samsung smartphones are banned from sale in America. Judge Lucy Koh has said they will have to wait until a December 6th hearing.

Koh initially said that the hearing would be scheduled for September 20th, so she could hear the injunction requests from Apple, however that hearing is now planned to hear Samsung’s request to kill the preliminary injunction against the Galaxy Tab 10.1 tablet.



Judge Koh said “Having considered the scope of Apple’s preliminary injunction request, the additional post-trial motions that the parties have already filed and will file, and the substantial overlap between the analysis required for Apple’s preliminary injunction motion and the parties’ various other post-trial motions, the Court believes consolidation of the briefing and hearing on the post-trial motions is appropriate.”

This is good news for Samsung fans in America, as they have until the end of the year to pick up the ‘infringing’ devices before any further legal action could be taken.
